1. Introduction
Welcome to Vimomo! Vimomo is an online platform provided by Vimomo Cultural Media Limited or its affiliates, focusing on short dramas (mini-series), short videos, and related content. The services include but are not limited to mobile applications, websites, associated software, and features such as short drama viewing, interactions, payments, creation, and sharing (collectively referred to as "Vimomo" or the "Services").
Contracting Parties
This User Agreement (the "Agreement" or "Terms") is a legally binding agreement between you ("User" or "You") and the Vimomo operating entity. Depending on the specific services, there may be service-specific terms; if applicable, such terms will clearly identify the contracting party. This Agreement and any service-specific terms together constitute the complete agreement between you and the relevant entity.
Age Requirements
Vimomo is not intended for children under 13 years old ("Children"). Children are not permitted to use the Services. Vimomo will not intentionally collect or accept personally identifiable information from users under 13. If such users are discovered, Vimomo will immediately terminate the account and delete the relevant information. Users aged 13-18 ("Teenagers") must use the Services under the following conditions: (a) The teenager and their parents/legal guardians jointly agree to this Agreement; (b) Use an account created and supervised by the parents/guardians. If you allow a teenager to use the Services, you represent that you and the teenager jointly accept this Agreement and assume all responsibility for the teenager's usage.
Acceptance of the Agreement
By using Vimomo, you indicate that you have read, understood, and unconditionally accept this Agreement. If you are under 18, you must obtain consent from your legal guardian. If you do not agree to this Agreement, please immediately stop using the Services. You also agree to comply with supplementary policies, operational rules, and privacy policies issued by Vimomo from time to time (provided via links on the website or app).
2. Your Account
Some services can be used without logging in, but full features (such as paid viewing, interactions, creation) require account registration. When registering, you promise: (a) To provide true, accurate, up-to-date, and complete information; (b) To update information promptly. If the information is inaccurate, Vimomo has the right to suspend or terminate the account. You are responsible for maintaining the security of your account and password, and for all activities under your account. You may not sell or transfer your account (unless explicitly permitted by the platform). If you discover unauthorized use, please immediately notify Vimomo (contact: feedback@vimomo.tv or in-app feedback). You may log in quickly via third-party platforms (Facebook, Google, Apple, etc.), and must comply with their terms; Vimomo is not responsible for third-party content. Account Deletion: Apply for permanent deletion via in-app settings or email to feedback@vimomo.tv. After deletion, content (including paid content) cannot be recovered. Vimomo may, at its discretion, suspend or terminate accounts due to violations of the Agreement, prolonged inactivity, legal requirements, etc., without prior notice, and delete related content.
3. Service Content and Intellectual Property
Except for user content, all content on Vimomo, including short dramas, videos, text, images, music, animations, LOGO, interface designs, etc. ("Platform Content"), belongs to Vimomo or its licensors and is protected by copyright, trademark, patent, and other intellectual property laws, including Indonesian intellectual property laws. Without prior written consent from Vimomo, you may not copy, modify, distribute, or commercially use Platform Content, or obtain content through automated means (crawlers, scripts, etc.). Paid content (such as paid short dramas) grants you only a personal, non-commercial, limited, revocable viewing license, and you may not download, share, or transfer it. This platform serves only as a technical platform for content display and dissemination; all uploaded content's copyright and responsibility lie with the users.
4. User Content
Content you upload, post, or share, such as comments, danmaku, short videos, avatars, etc. ("User Content"), belongs to you, but you grant Vimomo a worldwide, non-exclusive, transferable, sublicensable perpetual license, including but not limited to display, distribution, adaptation, and use for advertising promotion. You warrant that User Content does not infringe third-party rights and does not contain illegal/harmful information. Vimomo has the right to review, delete violating content, and pursue liability.
5. Fees, Payments, and Virtual Items
Some short dramas/functions require paid unlocking. You agree that Vimomo processes payments through third-party channels (such as Google Play, Apple Pay, local gateways like Dana, OVO, GoPay). After successful payment, virtual items (such as reward coins, gold coins, VIP privileges) are non-transferable and non-refundable (except as otherwise provided by law). Vimomo may adjust prices and promotion rules at any time and provide advance notice.
6. Prohibited Behaviors
You must not engage in the following behaviors (including assisting others): · Violating laws, the Agreement, or harming Vimomo/third-party rights, including Indonesian ITE Law; · Posting illegal, harmful, pornographic, violent, discriminatory, false, gambling, hate speech, etc.; · Abusing or interfering with services (brushing volume, attacking servers, cheating, malware); · Commercial use of services (reselling accounts, advertising, etc., unless authorized by the platform); · Reverse engineering, cracking, or modifying services; · Collecting other users' data or sending spam; · Screen recording, illegal downloading, or distributing Platform Content. Violations allow Vimomo to immediately terminate services, delete content, and pursue legal liability.
7. Disclaimer and Limitation of Liability
Vimomo provides services "as is" and does not guarantee uninterrupted, error-free, virus-free operation, or full satisfaction of your needs. Vimomo is not responsible for user content or third-party links/ads. Short drama content is provided by licensors, and Vimomo does not assume responsibility for its authenticity/legality (except as otherwise provided by law). To the extent permitted by law, Vimomo and its affiliates are not liable for any indirect, incidental, or punitive damages. Direct damage liability is limited to the total fees you paid to Vimomo in the past 12 months. The platform is not responsible for service interruptions, data loss, etc., caused by force majeure or technical reasons.
8. Service Changes, Termination, and Notices
Vimomo may modify services, fees, or this Agreement at any time; major changes will be notified in advance via in-app announcements, emails, or pushes. Continued use constitutes acceptance of changes. Vimomo may terminate all or part of the services due to business adjustments, legal requirements, etc., with advance notice.
9. Governing Law and Dispute Resolution
This Agreement is governed by the laws of the Republic of Indonesia. Disputes arising from this Agreement shall be resolved through negotiation; if unsuccessful, they shall be submitted to the Indonesian National Arbitration Board (BANI) in Jakarta or the designated court.
10. Miscellaneous
The English version of this Agreement shall prevail. If any provision is held invalid, the remaining provisions shall remain in effect.
